Christopher Howells successfully represented a former teacher in her claim for disability discrimination and unfair dismissal before the Cardiff Employment tribunal. The Claimant, who suffered with Bi-Polar disorder, was found to have been dismissed for a reason arising from her disability. Separate findings were also made that the duty to make reasonable adjustments had been breached in a number of material respects. The Tribunal found that as a consequence of the employer’s actions it was unlikely that the Claimant would work again and her damages were therefore calculated on the basis of a career-long loss at the age of just 48. She was awarded £347k in damages.
